Bus Tour Turns Tragic Due to Faulty Brakes
It has almost been three years since the lives of eight Mexican tourists were claimed and several others were left injured on a bus trip back from Big Bear here in California.
The bus, operated by Scapadas Magicas, LLC, transported 38 tourists up to Big Bear so that they could see the snow in the San Bernardino Mountains. As the bus descended the steep mountain road to return to Tijuana, the driver shouted out for help from the passengers, stating that the bus brakes had failed.
As the bus careened uncontrollably down the hill it rear-ended a Saturn sedan. The bus continued to swerve, flip and eventually flopped onto its side before a Ford pickup slammed into its side. This impact forced the bus upright, which caused passengers to be tossed out of the bus. The bus finally came to a stop on the side of the road.
A Sketchy Safety History
The bus, operated by a company out of National City, California, had 22 recorded safety violations in the year ending in October 2012. Some of these safety violations included:
- Brake problems
- Windshield problems
- Tire problems
The company had an overall “satisfactory” rating from the Federal Motor Carrier Safety Administration, however the number of buses operated by the firm failed 36% of random inspections. The national average for similar companies is 21%.
Compensation Being Demanded for Injuries
Recently a mother and daughter who were injured in the Southern California bus crash filed a lawsuit in San Bernardino County Superior Court against the tour bus operator as well as the charter company which organized the trip.
Guillermina Morales is suing for compensation related to the two broken legs and a broken pelvis she suffered because of the accident. She has also lost the use of one of her arms. Daughter Pamela Morales is also part of the lawsuit as she suffered a broken arm.
