Do the deceased men’s heirs have grounds to file a lawsuit against the hit and run driver?

Based on the investigation to date, it is likely. Depending upon the outcome of the police investigation the deceased may have a basis for filing a lawsuit against the driver. In a wrongful death or wrongful injury lawsuit the injured or deceased party’s heirs may file a civil action to recover damages related to the injuries suffered or death.
