On February 24 2015 a tragic accident left one person dead and several others injured. Do the deceased individual’s heirs have any legal remedy related to the death of their family member? Doe the injured parties have any legal grounds to recover for their injuries and pain and suffering?
Likely, yes. In most traffic accidents the police are able to determine fault; either partial or complete and attribute it to one or more parties involved in the accident. In a wrongful death lawsuit the deceased parties heirs sue to recover damages related to the loss of their family member. In a wrongful injury lawsuit the injured parties file suit to recover damages stemming from their injuries. Recoverable damages include, but are not limited to, compensation for lost property, injuries, pain and suffering and associated emotional suffering.
